This Release and Waiver (“Release”) by the Participant releases Abbey of the Arts (“AoA”) and the Institute for Creative Mindfulness, Inc.(“ICM”), its subsidiaries and affiliates, directors, officers, faculty, consultants, employees, and agents, and their respective successors and assigns (AoA and ICM) from all liability relating to the activities described below. The Participant desires to participate in a voluntary gathering that includes contemplative practice, group sharing and movement such as yoga, dance, or other expressive movement offered by AoA and ICM’s faculty, consultants, or affiliates (“Event”).

I release and forever discharge and hold harmless AoA and ICM from any and all liability, claims, and demands of any nature, either in law or in equity, which arise or may hereafter arise from my participation in the Event. I understand and acknowledge that this Release discharges AoA and ICM from any liability or claim that I may have with respect to bodily injury, personal injury, illness, death, mental distress or property damage that may result from my participation in the Event.

I understand that AoA and ICM assumes no obligation to provide me with financial or other assistance, including but not limited to workers’ compensation, medical, health, or disability benefits or insurance. I expressly waive any such claim for compensation or liability on the part of AoA and ICM in the event of injury or medical expenses incurred by me. I am responsible for my own insurance coverage in the event of personal injury or illness as a result of participation in the Event.

I agree to indemnify and hold harmless AoA and ICM from any and all claims brought by or on behalf of me, my spouse or dependent children resulting from my participation in the Event.

I hereby release and forever discharge AoA and ICM from any claim whatsoever that arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with my participation in the Event.

I represent that I am physically fit to perform all activities that may be associated with or required by the Event and agree that I am solely responsible for all health risks associated with such activities. If I have concerns, I have addressed them with my treating physician. Any modifications made in the course to address physical limitations are not a substitute for professional medical advice.

Abbey of the Arts and The Institute for Creative Mindfulness recognizes the ongoing threat of the coronavirus throughout the United States. We are committed to following any state and national guidelines that are in place for your safety at the time of this Event. Similarly, we encourage you to be an active participant in your safety as well: feel free to bring anything that would help you be more comfortable (e.g., masks, face shields, hand sanitizer). If you are experiencing symptoms of COVID-19 or have been exposed to COVID-19 prior to the Event, please stay home. We will convert your registration to the online option so you may join live via Zoom. The Event will be recorded you will have access to the recording. We request that all participants attending be vaccinated against COVID-19 or be willing to wear a mask and social distance. Depending on the rate of community transmission at the time of the Event, additional safety measures may be employed including proof of a negative COVID test prior to attending the Event.

This Event is non-refundable. If you are ill or unable to attend for any other reason we will convert your registration to the online option so you may join live via Zoom. The Event will be recorded and made available 48-72 hours after the gathering. We will send an email notification when it is available.

Without prejudice to the consumers statutory rights the organizer reserves the right to Alter, Change, Curtail, or Cancel the Event. Sometimes it is necessary to cancel an Event due to extraordinary events such as pandemic, war, or natural disaster. In this case we would refund all monies paid by you. We can offer a transfer of the full amount of payment to a future AoA program or online AoA self-study program instead. We are not responsible for any other losses, including your travel expenses which you may incur due to this cancellation.

I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Ohio and that this Release shall be governed by and interpreted in accordance with the laws of the State of Ohio and any disputes be brought in and subject to the jurisdiction of the courts of the State of Ohio, County of Trumbull. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.

By SIGNING THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, I ACKNOWLEDGE THAT I HAVE READ THE WAIVER IN FULL AND FULLY UNDERSTAND ITS TERMS, INCLUDING BEING ADVISED I SHOULD OBTAIN INDEPENDENT LEGAL ADVICE, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME. I INTEND MY SIGNATURE TO BE THE ACCEPTANCE OF THIS OFFER.
